End User License Agreement

1. License, Not A Sale

this end user license agreement is a legal contract between you and the operator of peli. the peli application is licensed, not sold. apple and apple's subsidiaries are not parties to this license except as third-party beneficiaries as described below. by installing or using peli, you accept this agreement. if you do not accept it, do not install or use peli.

2. Age Requirement

you must be at least 18 years old to accept this license and to use peli. peli is not licensed for use by children.

3. Scope Of License

the operator of peli grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use peli on devices that you own or control, and only as permitted by the usage rules of the apple app store.

this license lets you use peli for your own private journaling and reflection. it does not allow you to rent the app, run it as a commercial writing service, or share your license except where apple family sharing rules expressly allow access on linked devices.

4. Licensed Content

prompts, visual design, trademarks, and software code are licensed content. vip benefits, coins, and prompt packs, if you acquire them, are licensed in the same way. you may not copy licensed content into another product, train a public model on it, or present it as your own product.

your own journal entries remain yours, subject to the peli terms of use. this license does not give the operator ownership of text or photos you create, and it does not give you ownership of peli.

except as a statute expressly allows, you may not:

6. Digital Items And Subscriptions

purchased items are licensed for personal use within peli, have no cash value, and may not be sold, transferred, or redeemed for cash, except as permitted by apple family sharing. purchased virtual currency does not expire. apple bills the price and decides refunds. additional purchase rules, including auto-renew and restore, are in the terms of use.

after a reinstall, restore eligible purchases with the apple account associated with the purchase. ending this license does not by itself stop apple from billing a subscription; cancel in Settings → [your name] → Subscriptions.

7. Updates And Maintenance

peli may provide updates that add, change, or remove prompts or features. updates may be required for continued compatibility with a new operating system. we do not promise that every device or os version will remain supported. this license applies to updates unless a separate license accompanies them.

8. Store Terms

if you obtained peli from the apple app store, the apple licensed application end user license agreement and apple media services terms also apply. where those apple terms assign a role to apple — including billing, refunds, family sharing, and store usage rules — and this eula says something else about that role, apple's terms control to the extent required.

maintenance and support for peli are the responsibility of the operator of peli, not apple. you may contact support at larenityofarhazubiandoro@outlook.com.

9. Consent Related To Data

peli handles information as described in the peli privacy policy. by using the app you consent to that handling, including storing and processing journal content to provide the service, and the limited technical information needed for installs, support, and purchase unlocking or restore through your apple id. peli does not require you to share journal entries with other users.

10. Termination

this license is effective until you or we end it. it ends automatically if you fail to comply with it. you may end it by deleting peli from your devices. upon termination you must stop using the app and delete all copies in your possession. sections that should survive, including ownership, purchase licenses, disclaimers, liability limits, and third-party beneficiary terms, remain in effect.

ending this license does not automatically cancel store records held by apple. apple handles refunds and apple id billing under apple's own terms.

11. No Warranty

peli is provided as is and as available, with all faults and without warranty of any kind. to the maximum extent permitted by law, the operator of peli disclaims all warranties and conditions, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy of prompts, and non-infringement.

peli does not warrant that journaling will improve mood or health, that the app will be uninterrupted, or that defects will be corrected. if applicable law requires an implied warranty that cannot be disclaimed, it lasts only for the minimum period such law requires.

if peli fails to conform to any warranty that cannot be disclaimed, you may notify apple, and apple may refund the purchase price you paid to apple for the app, if any. to the maximum extent permitted by law, apple will have no other warranty obligation for peli. this paragraph does not create a price list; it only describes apple's limited refund role for the licensed application.

12. Limitation Of Liability

to the maximum extent permitted by law, in no event will the operator of peli, or its directors, licensors, or suppliers, be liable for personal injury or any incidental, special, indirect, or consequential damages, including loss of data, loss of entries, or business interruption, even if advised of the possibility.

except where the law forbids this cap, the total liability of the operator of peli for all claims under this license will not exceed the amount you paid for the licensed application or related in-app item giving rise to the claim through the app store in the twelve months before the claim. if you paid nothing, liability is limited to the smallest amount the applicable law still allows. these limits are intended to apply even if a remedy fails of its essential purpose.

13. Export And Legal Compliance

you may not use or otherwise export or re-export peli except as authorized by the laws of the united states and the laws of the jurisdiction in which peli was obtained. you represent that you are not located in a country subject to a u.s. government embargo, and that you are not on any u.s. government list of prohibited or restricted parties.

14. Government Users

peli and related documentation are commercial computer software and commercial computer software documentation. if you are a u.s. government end user, you receive only those rights customarily provided to civilians under this license, consistent with applicable federal acquisition rules.

15. Third-Party Beneficiary

if you obtained peli from the apple app store, apple and apple's subsidiaries are third-party beneficiaries of this eula. upon your acceptance, apple will have the right to enforce this eula against you as a third-party beneficiary. apple is not responsible for peli content, warranties beyond any refund apple may provide for the app itself, or product claims, intellectual property claims, or consumer-protection claims relating to peli. those matters are directed to the operator of peli at larenityofarhazubiandoro@outlook.com.

16. Governing Law

except to the extent required by apple for apps obtained from the app store, this license is governed by the laws applicable to the operator of peli, excluding conflict-of-law rules. mandatory consumer protections in your country of residence remain available. this license will not be governed by the united nations convention on contracts for the international sale of goods.

17. Entire License

this eula, together with the peli terms of use and privacy policy, is the entire license between you and the operator of peli for the application. if a provision is held invalid, the remaining provisions continue. headings are for convenience only.
